Official Rules for the Hotels.com “Ferdinand” DVD/Blu-Ray/HD Release Sweepstakes
No Purchase Necessary. A Purchase Will Not Increase Your Chances of Winning.
1. Eligibility: The Hotels.com “Ferdinand” DVD/Blu-Ray/HD Release Sweepstakes (the “Sweepstakes”) is open only to legal residents of the Brazil, Canada (excluding Quebec), Denmark, France, Finland, Germany, Japan, Mexico, South Korea, the United Kingdom, and the United States who are at least eighteen (18) years old or the age of majority in their jurisdiction of residence. Employees of Hotels.com, L.P. (“Sponsor”), as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, are not eligible to enter.
2. Agreement to Official Rules: By entering the Sweepstakes, you indicate your full and unconditional agreement to, and acceptance of, these Official Rules and Sponsor’s decisions regarding the Sweepstakes, which are final and binding. Winning a prize is contingent upon fulfilling all requirements in these Official Rules.
3. Entry Period: The Sweepstakes begins at 12:00am CT on March 15, 2018, and ends at 11:59pm CT on April 15, 2018 (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Sweepstakes.
4. How to Enter: To enter the Sweepstakes, during the Entry Period, go to www.hotels.com/page/ferdinand and follow the instructions to enter. There is a limit of one (1) entry per person. Sponsor reserves the right to disqualify anyone who attempts to obtain more than one (1) entry, by any means. You may be required to agree to receive marketing emails from Sponsor or its affiliates in order to enter. You may unsubscribe at any time.
5. Drawing: After the Entry Period, Sponsor will select one (1) potential winner in a random drawing of all entries received. The odds of being selected depend on the number of entries received.
6. Notification and Requirements of Potential Winner: Sponsor will attempt to notify the potential winner via email within ten (10) calendar days of the drawing. Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release. In order to win the prize, a potential winner who is a resident of Canada must correctly answer (unaided) a time-limited mathematical skill-testing question. If a potential winner fails to respond to the notification, to sign and return the required documents, or to correctly answer the skill-testing question within three (3) days, he/she will forfeit the prize, and Sponsor may select an alternate potential winner in a random drawing of all remaining entries received. Only three (3) alternate potential winners will be contacted.
7. Prize: One (1) winner will receive a trip for the winner and one (1) guest to Madrid, Spain. The trip consists of:
a. Roundtrip, coach-class air transportation from a major international airport in the capital city of the winner’s country of residence, or from a major international airport nearest to the winner’s residence if the winner is from the United States, to Madrid, Spain. The winner and guest must travel together on the same itinerary.
b. Four (4) days and three (3) nights hotel accommodations (one room, double occupancy) in a luxury hotel (to be determined by Sponsor in its sole discretion) in Madrid, Spain. The stay must include one (1) Saturday night. The winner will be required to provide a debit or credit card upon hotel check-in for incidentals.
c. A VIP City Sightseeing Card, which includes admission to museums and other attractions, for the winner and guest for twenty-four (24) hours.
The approximate retail value of the prize is $4,995 USD. The actual value may vary based on various factors, including the date of booking and point of departure. Any difference between the stated value and actual value will not be awarded. The prize must be redeemed within one (1) year after the winner is notified that he/she has won, and is subject to availability and blackout dates (including Christmas, New Year’s, and public holidays in Spain or the winner’s country (and/or city/state, as applicable) of residence). The guest must be of legal age of majority in his/her jurisdiction of residence, unless the child or legal ward of the winner. The guest may be required to sign a liability/publicity release. Either the winner or the guest must be at least twenty-one (21) years of age. The winner and guest are responsible for obtaining any required travel documentation prior to departure. Once booked, travel arrangements may not be changed.
The winner is responsible for paying any applicable income taxes and any and all other costs and expenses not listed above, including transportation to/from the airport and meals. Any prize details not specified above will be determined by Sponsor, in its sole discretion. A prize may not be transferred and must be accepted as awarded. A winner may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize (or a component thereof) is not available for any reason, as determined by Sponsor, in its sole discretion.
8. General Conditions: In the event that the operation, security, or administration of the Sweepstakes is impaired in any way, Sponsor may, in its sole discretion, either (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual who tampers with the operation of the Sweepstakes, violates these Official Rules, or acts in an unsportsmanlike or disruptive manner. Sponsor reserves the right to seek damages from any person who attempts to undermine the legitimate operation of the Sweepstakes to the fullest extent permitted by law. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. In the event of a dispute as to the owner of an entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The Sweepstakes is subject to federal, state, provincial, and local laws and regulations and is void where prohibited.
9. Release and Limitations of Liability: By entering, you agree to release and hold harmless Sponsor, Twentieth Century Fox Home Entertainment LLC, their parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (f) errors in the administration of the Sweepstakes or the processing of entries; or (g) injury or damage to persons or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorneys’ fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
10. Privacy and Publicity: Any information you submit as part of the Sweepstakes will be used for purposes of this Sweepstakes and treated in accordance with Sponsor’s Privacy Policy. Except where prohibited, participation in the Sweepstakes constitutes an entrant’s consent to Sponsor’s use of his/her name, likeness, voice, opinions, biographical information, and city/state of residence for promotional purposes in any media without further payment or consideration.
11. Disputes: You agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Texas, United States. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Texas, without giving effect to any choice of law or conflict of law rules (whether of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Texas.
12. Results: For the name of the winner, send a self-addressed stamped envelope to Attn: Abby McGowen, Hotels.com, L.P., 5400 LBJ Freeway, Suite 500, Dallas, TX 75240. Requests must be received within four (4) weeks of the end of the Entry Period.
